More Flint, Michigan residents can advance substantive due process claims against city and state officials for allegedly creating, ignoring, and covering up the notorious water crisis that poisoned thousands, the Sixth Circuit ruled Wednesday, despite some contention over who ought to receive qualified immunity.

The appeals court’s decision was propelled by its recent ruling in Waid v. Snyder, which held that government officials, including former Michigan Gov. Rick Snyder (R) and current Gov.
